Terms of Service

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 18 years old, have the legal authority to enter into these Terms, and agree to comply with all applicable laws and regulations. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Description of Service

JobPulse365 is a customer relationship management (CRM) platform designed for home service businesses. The Service includes job pipeline management, contact management, review management, invoicing, AI powered features, and related tools. Features may vary by subscription plan and may be updated, modified, or discontinued at our discretion.

3. Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Pricing

JobPulse365 offers a free trial period followed by paid subscription plans. By subscribing to a paid plan, you agree to the following:

• Billing: You will be billed on a recurring basis (monthly or annually) based on the plan you select. All fees are quoted in U.S. dollars.
• Payment: Payment is processed securely through Stripe. You authorize us to charge your payment method for all fees due.
• Price Changes: We may change our pricing with at least 30 days’ notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
• AI Credits: Certain AI powered features consume credits based on usage. Credit allowances vary by plan. Additional credits may be purchased separately.
• Refunds: Subscription fees are non-refundable except as required by applicable law. If you cancel during a billing period, you will retain access until the end of that period.

5. Free Trial

We may offer a free trial period for new users. At the end of the trial, you must subscribe to a paid plan to continue using the Service. If you do not subscribe, your account may be suspended and your data may be deleted after a reasonable notice period.

6. Your Data

You retain ownership of all data you enter into the Service (“Your Data”). By using the Service, you grant us a limited license to use, process, and store Your Data solely to provide and improve the Service. We will not sell Your Data to third parties.

You are responsible for the accuracy, quality, and legality of Your Data and the means by which you acquired it. You must ensure that your use of the Service complies with all applicable data protection laws, including when entering customer information into the platform.

7. AI Powered Features

The Service includes AI powered features such as automated review responses, sentiment analysis, and business insights. You acknowledge and agree that:

• AI generated content is provided as suggestions and should be reviewed before use.
• You are responsible for any AI generated content you choose to publish or send.
• AI features may produce inaccurate or inappropriate results. We do not guarantee the accuracy, completeness, or suitability of AI generated content.
• AI generated content should not be relied upon as professional, legal, financial, or medical advice.

8. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third party rights.
• Send spam, unsolicited messages, or bulk communications without proper consent.
• Upload or transmit malicious code, viruses, or harmful content.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service to harass, threaten, or harm others.
• Scrape, crawl, or use automated means to access the Service without our written permission.
• Resell or redistribute the Service without our written authorization.

9. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is owned by JobPulse365 and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service, or reverse engineer or attempt to extract our source code, except as permitted by law.

10. Third Party Integrations

The Service may integrate with third party services such as Google Business Profile, Google OAuth, Stripe, Square, PayPal, QuickBooks Online, Twilio, Resend, Anthropic (AI), and PostHog (analytics). Your use of these integrations is subject to the respective third party’s terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third party services.

11. Service Availability and Modifications

We strive to maintain high availability but do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable for any modification, suspension, or discontinuation of the Service.

12. Termination

You may cancel your account at any time through your account settings or by contacting us. We may suspend or terminate your account if you violate these Terms or for any reason with reasonable notice. Upon cancellation, your account will remain active until the end of your current billing period. After that date, your access to the platform will be suspended. We may retain Your Data for a limited period to allow for data export, after which it may be permanently deleted.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBPULSE365 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to indemnify, defend, and hold harmless JobPulse365 LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party rights.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page, updating the “Last Updated” date, and where appropriate, notifying you by email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
